New E-Verify Law for Georgia Companies

As of July 1, 2013, the state of Georgia will require employers with 11-99 employees to verify their newly-hired employee’s legal statuswithin 3 days of being hired using the e-Verify program. This ruling does not apply to current employees.

E-Verify is an Internet-based system operated by the U.S. Citizenship and Immigration Services that allows employers to confirm the employment eligibility of new hires. Information is submitted online directly off of the I-9 form and will immediately confirm if there is a match or a “non-confirmation.” All non-confirmations must be successfully resolved within 8 federal government workdays. If the employee receives a final non-confirmation after attempts to resolve, the employee can be terminated based on e-Verify.

GA clients should be receiving a “2013 Private Employer E-Verify Affidavit” about the program; a representative from your company will need to complete this no later than February 15th. By completing this affidavit, it notifies the city in which your license is registered that you qualify to participate in e-Verify. There is no correlation between the affidavit and setting up your business through e-Verify.
